Dangerous Driving

    Earlier this year a lorry broke down on the M69. Driver got out and was phoning for help when his vehicle was hit by another truck which had been observed seconds earlier weaving between hard shoulder and lane 1. Driver of broken down truck died at the scene.

    Second lorry's driver was viewing porn on his phone. He's got 6 years for death by dangerous and 2 more consecutively for attempting to pervert the course of justice by disposing of the phone.

    So far years then. For killing someone. He's got off lightly.

    The judge has topped him up a bit with the extra two years for perverting the course, making eight in total.

    The guidelines the judge referred to are on page 11 of this document.

    Seems to me the driver is a lucky lad to be put into category two - driving that created a substantial risk of danger.

    Category one - a flagrant disregard for the rules of the road - would be a better fit.

    That would give a range of seven to 14 years - the maximum.

    However, the judge will always win because had he gone for the starting point of that range - eight years - he could have made the pervert the course concurrent, citing 'totality'.
